Welcome to Calmada Expedition. These Terms and Conditions govern your access to and use of our services, including the booking of private multiday expeditions offered through our website or directly via our representatives.

By booking a tour or using any part of our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

1. Booking and Payment

All bookings are subject to availability and confirmation.
Prices are listed in Philippine Pesos (PHP) and may vary based on the destination, duration, or group size.
To confirm the booking, we will ask for a deposit of 50%
Full payment can be done on day of departure.
Once a booking is confirmed, you will receive a written confirmation via email.

2. Cancellations and Refunds

Cancellations must be submitted in writing.
Cancellation policies (including any refund eligibility) will be outlined in your booking confirmation and may vary depending on the specific tour and can be seen under Cancellation & Refund.
Calmada Expedition reserves the right to cancel or reschedule tours due to unforeseen circumstances (e.g., weather conditions, safety risks). In such cases, clients will be offered an alternative date or refund, as appropriate.

3. Travel Insurance

All participants are strongly advised to obtain comprehensive travel insurance that covers medical emergencies, cancellations, lost belongings, and other unforeseen events.
Calmada Expedition is not responsible for any costs incurred due to lack of adequate travel insurance.

4. Health and Safety

You must inform us of any pre-existing medical conditions or dietary restrictions before the tour begins.
Calmada Expedition reserves the right to refuse participation to anyone whose health condition may pose a risk to themselves or others.
All participants are expected to follow safety instructions and behave respectfully toward guides, other participants, and local communities.

5. Personal Data

We collect and store personal information such as your name, contact details, and payment information to process your bookings and communicate with you.
Your data will be handled in accordance with our [Privacy Policy] and will not be sold or shared with third parties, except as required to provide our services (e.g., for lodging or transport bookings).

6. Intellectual Property

All content on our website, including text, photos, logos, and branding, is the intellectual property of Calmada Expedition and may not be copied, reproduced, or distributed without permission.

7. Limitation of Liability

Calmada Expedition is not liable for any loss, injury, damage, delay, or inconvenience caused by third-party services, force majeure, or any unforeseen event beyond our control.
Participation in our tours is voluntary, and by booking, you accept all inherent risks associated with adventure travel.

8. Jurisdiction and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Philippines.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that location.

9. Changes to Terms

Calmada Expedition reserves the right to modify these Terms at any time. Updates will be posted on our website, and continued use of our services after changes constitutes your acceptance.

Limitation of Liability

Calmada-Expedition cannot be held responsible, or in any way liable, for such things as property losses or damages, personal losses, accidents, medical expenses, repatriation expenses, rescue expenses, injuries or death for any reason, whether through activities organized by us or booked through us, or caused to you by third parties connected or not connected to us. We’re not liable for any additional expenses (including but not limited to, visas, accommodation expenses, non-refundable flights or transportation tickets) incurred by an Adventurer whatever may be the reason or circumstances of these expenses.

Calmada-Expedition may contract with a network of partners ("third parties") including, but not limited to, van companies, boat companies, tour guides, tour organizers, dive centers, hotels, inns and resorts, to assist in the running of our activities/services. Calmada-Expedition, its affiliates, owners, officers, agents, employees, contractors shall not be held liable nor responsible for the acts and omissions of these thirds parties.

You further understand that Calmada-Expedition neither owns nor operates such third parties and accordingly, agree to seek remedies directly and only against those third parties and not hold Calmada-Expedition responsible for their acts or omissions. In no event will Calmada-Expedition be responsible for incidental, consequential or special damage or loss suffered by any person. Calmada-Expedition maximum liability, for any reason whatsoever, will be limited to the amount paid to Calmada-Expedition for its services.

Without limitation, Calmada-Expedition is not responsible for any negligent acts or omissions of itself or of any persons for whom it would otherwise be responsible, or acts which are beyond its control, including but not limited to acts of God or force majeure, weather emergencies, breakdown, or failure of diving or mechanical equipment, government actions, inclement weather, sickness, attacks by animals, availability of emergency evacuation or medical care or the adequacy of the same, criminal activity of any kind, terrorism, war, civil disturbance, sanitary conditions, quality or sanitation of food, quarantine, customs, regulations, epidemics, strikes, hotel overbooking, safety and/or security standards at hotels, accommodations or otherwise, or for any other reason beyond the control of Calmada-Expedition. You understand, agree with, and agree to be legally bound by the terms of the release and waiver of liability set forth herein.

Adventurer(s) using the services of any personal service personnel, if carried on board, or using athletic or recreational equipment, facilities or supplies, does so at the Adventurer’s own risk and expense, without any responsibility of Calmada-Expedition.
