CANCELLATION, FORCE MAJEURE, AND REFUND TERMS

1. Definitions

“Force Majeure” means any event beyond the reasonable control of Calmada Expedition, including but not limited to adverse weather or sea conditions, typhoons, government restrictions, Coast Guard or port authority decisions, natural disasters, war, civil unrest, strikes, epidemics, or any event making performance unsafe or impossible.

2. Operator Cancellation (Non-Force Majeure)

If Calmada Expedition cancels an expedition for operational reasons not caused by Force Majeure, guests are entitled to a full refund of amounts paid for the affected booking.

3. Force Majeure Events

Where a Force Majeure event occurs, Calmada Expedition shall not be liable for failure or delay in performance.

Calmada Expedition will, where reasonably possible:

  • Offer an alternative departure date; or

  • Coordinate rescheduling of the expedition

Decisions by the Philippine Coast Guard or relevant authorities regarding safety and departure clearance shall be final.

4. Financial Treatment in Force Majeure Situations

All bookings are bundled expedition packages that may include pre-arranged accommodation, transport, permits, and other operational services.

If a Force Majeure event prevents completion of the expedition:

  • If rescheduling is possible, the booking will be transferred to a new date; or

  • If rescheduling is not possible within a reasonable timeframe, the guest will be entitled to either a travel credit or a refund of the unused portion of the booking

Any refund or credit may be reduced by verifiable non-recoverable costs already incurred or contractually committed for the specific booking.

“Non-recoverable costs” refer only to expenses already paid or legally committed on a non-refundable basis to third-party suppliers for the guest’s booking, supported by supplier terms or documentation where applicable.

5. Additional Costs During Delays

Any additional expenses arising from Force Majeure delays, including accommodation, meals, transport, or incidental costs, shall be borne by the guest unless expressly included in the booking.

6. No Liability for Indirect Losses

Calmada Expedition shall not be liable for indirect or consequential losses, including but not limited to missed flights, loss of enjoyment, additional accommodation, or travel disruption outside the expedition scope.

7. Client Cancellations

Client cancellations are subject to the following terms:

  • More than 30 days before departure: PHP 5,000 cancellation fee

  • 14–30 days before departure: 50% of booking price forfeited

  • Less than 14 days before departure: no refund

  • No-show: no refund

8. Insurance Recommendation

Guests are strongly advised to obtain comprehensive travel insurance covering medical emergencies, evacuation, trip cancellation, and weather-related delays.

Calmada Expedition does not provide insurance and is not responsible for costs that may be covered by a guest’s insurance policy.
