Terms and Conditions

Welcome to Calmada Expedition. These Terms and Conditions govern your access to and use of our services, including the booking of private multiday expeditions offered through our website or directly via our representatives.

By booking a tour or using any part of our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

1. Booking and Payment

• All bookings are subject to availability and confirmation.

• Prices are listed in Philippine Pesos (PHP) and may vary based on the destination, duration, or group size.

• To confirm the booking, we will ask for a deposit of 50%

• Full payment can be done 14 days before departure.

• Once a booking is confirmed, you will receive a written confirmation via email.

2. Cancellations and Refunds

• Cancellations must be submitted in writing.

• Cancellation policies (including any refund eligibility) will be outlined in your booking confirmation and may vary depending on the specific tour and can be seen under Cancellation & Refund.

• Calmada Expedition reserves the right to cancel or reschedule tours due to unforeseen circumstances (e.g., weather conditions, safety risks). In such cases, clients will be offered an alternative date or refund, as appropriate.

3. Minimum Age Requirement

• Guests aged 10 years and older are welcome to join our expeditions. Children under the age of 10 are not permitted to participate.

• For our private expedition children younger than 10 are allowed, since our crew can focus more to the need of the children and have your support

• Parents or legal guardians remain fully responsible for the safety, supervision, and wellbeing of their children at all times throughout the expedition. Our guides and crew are responsible for operating the expedition and providing the planned activities and services, but they are not responsible for supervising or providing childcare for children.

• Please note that our expeditions take place in a remote island environment and on open waters, often far from medical facilities and other immediate assistance. Conditions can include boat transfers, swimming, snorkeling, beaches, rocky areas, changing weather and sea conditions, and other situations where additional care and attention may be required.

• Parents or legal guardians must therefore assess whether the expedition is suitable for their children and must ensure that their children follow all safety instructions given by the crew and guides. Our guides cannot guarantee the safety of a child who is not adequately supervised by their parent or legal guardian.

4. Travel Insurance

• Travel insurance is not included in the price of the expedition.

• All participants are strongly recommended to obtain comprehensive travel insurance before the expedition. The insurance should be suitable for the nature of the expedition and remote island locations and should, where applicable, cover accidents, injuries, illness and medical treatment, emergency evacuation, trip cancellation or interruption, lost or damaged belongings, travel delays, and other unforeseen events.

• Participants are responsible for ensuring that their insurance provides adequate coverage for their individual circumstances and for all activities undertaken during the expedition.

• Calmada Expedition is not responsible for any medical, evacuation, cancellation, travel, or other costs, losses, or expenses incurred by participants that are not covered by their insurance or that arise from a participant's failure to obtain adequate insurance.

5. Health and Safety

• Participants must inform Calmada Expedition before the expedition begins of any pre-existing medical conditions, injuries, disabilities, allergies, medication requirements, or dietary restrictions that may affect their participation, safety, or ability to receive appropriate care during the expedition.

• Participants are responsible for assessing whether they are physically and medically fit to participate in a multi-day expedition involving open-water travel, island transfers, swimming, snorkeling, kayaking, hiking, and other outdoor activities.

• The expedition takes place in remote island areas with limited medical facilities, limited access to emergency services, and potentially limited mobile communication. Participants acknowledge and accept the inherent risks associated with this environment.

• Calmada Expedition reserves the right to refuse or discontinue participation if, in the reasonable judgment of the company, a participant's health or physical condition may pose a risk to themselves, the crew, guides, or other participants, or if they are unable to safely participate in the expedition.

• Participants must follow all safety instructions and directions given by the captain, guides, and crew at all times. Safety decisions concerning sea conditions, navigation, activities, and the continuation or alteration of the expedition are made by the captain and, where applicable, local authorities.

• Participants must behave responsibly and respectfully toward guides, crew members, other participants, local communities, and the natural environment.

• Failure to follow safety instructions or reckless, disruptive, or dangerous behavior may result in the participant being excluded from an activity or, where necessary, from the remainder of the expedition, without entitlement to a refund.

• Participants are responsible for taking reasonable precautions regarding their own health and safety and are strongly recommended to maintain comprehensive travel insurance covering accidents, injuries, illness, medical treatment, and emergency evacuation.

6. Personal Data

• Calmada Expedition collects and processes personal information that is reasonably necessary to process bookings, arrange and operate expeditions, communicate with participants, and provide related services. This may include names, contact details, accommodation information, dietary requirements, health or safety information voluntarily provided by participants, and payment-related information.

• Personal information will be used only for legitimate business purposes related to the booking, operation, administration, and communication of the expedition, or where disclosure is required by law.

• We do not sell participants' personal information to third parties.

• Where necessary to provide the services booked, we may share relevant personal information with trusted service providers and partners, including accommodation providers, transportation providers, boat operators, guides, payment providers, and other suppliers involved in operating the expedition.

• We may also disclose personal information where required by law or by competent authorities, or where reasonably necessary to protect the safety, rights, or property of Calmada Expedition, our participants, or others.

• We take reasonable measures to protect personal information against unauthorized access, loss, misuse, or disclosure. However, no electronic system or method of data transmission can be guaranteed to be completely secure.7. Intellectual Property

• All content on our website, including text, photos, logos, and branding, is the intellectual property of Calmada Expedition and may not be copied, reproduced, or distributed without permission.

8. Limitation of Liability

• Calmada Expedition will take reasonable care in planning and operating the expedition. However, participation involves inherent risks associated with remote island travel, open-water transportation, swimming, snorkeling, kayaking, hiking, boat transfers, changing weather and sea conditions, and other outdoor and adventure activities.

• To the extent permitted by applicable law, Calmada Expedition shall not be liable for loss, injury, illness, damage, delay, additional expenses, or inconvenience arising from circumstances beyond our reasonable control, including severe weather, rough seas, storms, natural disasters, government or Coast Guard restrictions, changes in sea conditions, medical emergencies, accidents, illness, or other force majeure events.

• Calmada Expedition shall not be responsible for delays, cancellations, changes, deficiencies, or losses arising from third-party services or suppliers, including accommodation providers, transportation providers, boat operators, or other service providers, except to the extent that such liability cannot legally be excluded.

• The itinerary, route, activities, accommodation, or scheduled stops may be changed, shortened, postponed, or cancelled when necessary for safety or operational reasons. No particular route, destination, activity, accommodation, or itinerary stop is guaranteed.

• Safety takes priority over the planned itinerary. The captain and crew may alter the route or activities, seek shelter, delay departure, or return to a safe location based on weather, sea conditions, safety considerations, or instructions from local authorities. Such decisions do not automatically entitle participants to a refund or compensation.

• Participants acknowledge that remote island areas have limited infrastructure, medical facilities, emergency services, and communication, and that access to medical assistance or evacuation may take considerable time.

• Participants are responsible for their personal belongings, valuables, and equipment during the expedition. Calmada Expedition is not responsible for loss or damage to personal property except where caused by our negligence or where liability cannot legally be excluded.

• Participation is voluntary, and by booking and participating in the expedition, each participant acknowledges the inherent risks of adventure travel and agrees to follow all safety instructions provided by the captain, guides, and crew.

• Nothing in these Terms and Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

9. Jurisdiction and Governing Law

• These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict-of-law principles.

• Any dispute, claim, or controversy arising out of or in connection with these Terms and Conditions or the services provided by Calmada Expedition shall, to the extent permitted by applicable law, be subject to the jurisdiction of the competent courts of the Republic of the Philippines.

• The parties shall make reasonable efforts to resolve any dispute amicably and in good faith before commencing formal legal proceedings.

10. Changes to Terms

• Calmada Expedition reserves the right to update or amend these Terms and Conditions from time to time. The most current version will be published on our website.

• Changes to these Terms and Conditions will generally apply to new bookings made after the updated terms have been published.

• For existing confirmed bookings, the Terms and Conditions applicable at the time of booking will continue to apply, unless a change is required by law, necessary for safety or operational reasons, or otherwise agreed with the participant.

• Participants are encouraged to review the Terms and Conditions before making a new booking and before participating in an expedition.

Limitation of Liability

Calmada Expedition takes reasonable care in planning and operating its expeditions. However, participation in an expedition involves inherent risks associated with remote island travel, open-water transportation, boat transfers, swimming, snorkeling, kayaking, hiking, diving where applicable, changing weather and sea conditions, and other outdoor and adventure activities.

To the extent permitted by applicable law, Calmada Expedition, its owners, officers, employees, guides, agents, contractors, and affiliates shall not be liable for any loss, damage, injury, illness, medical expenses, evacuation or rescue expenses, delay, inconvenience, or additional costs arising from risks inherent in the expedition or from circumstances beyond Calmada Expedition's reasonable control.

This includes, without limitation, severe weather, storms, rough seas, natural disasters, acts of God, government or Coast Guard restrictions, changes in sea conditions, breakdowns, mechanical or equipment failure, illness, accidents, animal-related incidents, criminal activity, civil unrest, epidemics, quarantine, strikes, or other force majeure events.

Calmada Expedition may work with independent third-party providers, including boat operators, transportation companies, accommodation providers, guides, dive centers, activity providers, and other suppliers. While we select our partners with reasonable care, these providers are independent businesses. To the extent permitted by applicable law, Calmada Expedition is not responsible for acts, omissions, negligence, delays, failures, or other conduct of independent third-party providers. Any claims arising directly from a third-party service should, where appropriate, be directed to the relevant provider.

The expedition takes place in remote areas with limited medical facilities, emergency services, transportation options, and communication coverage. Calmada Expedition cannot guarantee the availability, speed, or adequacy of emergency evacuation, rescue services, or medical treatment. Participants are responsible for obtaining appropriate travel insurance covering, where applicable, accidents, injuries, illness, medical treatment, emergency evacuation, rescue, trip cancellation or interruption, and personal belongings.

Participants are responsible for their own personal belongings, valuables, and equipment. Calmada Expedition shall not be liable for loss, theft, or damage to personal property except where such liability cannot legally be excluded.

Participants are also responsible for any additional expenses arising from circumstances affecting their travel or participation, including but not limited to additional accommodation, flights, transportation, transfers, visas, meals, medical treatment, evacuation, or other personal expenses, unless such expenses are expressly included in the booking or Calmada Expedition is legally responsible for them.

The itinerary, route, activities, accommodation, and scheduled stops may be changed, postponed, shortened, or cancelled where necessary due to weather, sea conditions, safety concerns, operational requirements, or instructions from the captain, Coast Guard, or other competent authorities. Such changes do not automatically entitle participants to a refund or compensation.

Where Calmada Expedition is legally liable for a claim, its liability shall, to the maximum extent permitted by applicable law, be limited to the amount actually paid to Calmada Expedition for the affected expedition, except where a different limitation is required by law.

Nothing in these Terms and Conditions shall exclude or limit liability for death, personal injury, fraud, gross negligence, willful misconduct, or any other liability that cannot legally be excluded or limited under applicable law.

By booking and participating in an expedition, participants acknowledge the inherent risks of adventure travel and agree to comply with all safety instructions and directions given by the captain, guides, crew, and other authorized personnel.
